According to reports, police responded to a “disturbance” call at the restaurant at 11:15 p.m. and reportedly saw several individuals“intoxicated” and using “absurd” language when they arived.
Officers cleared up the fracas and dispersed the crowd, but the four men involved with the fight weren’t easily taken into custody.
Reports show that Carl McDaniel Faison, 25, of 134 Nicole Lane, Clinton, refused to comply with officers’ instructions and was promptly tased by an X-26 tazer gun. After being tased, Stevie Earl Smith, 24, of 441 Jacon Farm Lane, Clinton, came to the rescue of Faison and tried to pull the tazer probes out of him. Although he was ordered to let go of the probes and back away from Faison, Smith refused to do so. Reports show that the suspect “would not let anyone get near him to place him into custody”.
Again, Smith was advised to back away from Faison; again, he reportedly refused and is alleged to have cursed at and shoved one of the officers.
Officers Tina Jackson and Salah O’Neill then released a burst of O.C. spray into Smith’s face. Reports note that the spray had “absolutely no effect on Smith.”
Smith was then hit with the X-26 taser and five seconds of “electrical energy.” Although he fell to his knees, only one probe connected and Smith didn’t feel the entire effect of the taser. After the five seconds, Smith managed to get up and flee on foot.
Officers caught up to the suspect and hit him again with the taser. This time, both probes connected and Smith was ordered to lie on his stomach. He failed to do so and was promptly hit again. He then complied with officers’ orders and was arrested.
Faison was charged with resisting a public officer and being intoxicated and disruptive. He was given a $3,500 bond and a trial date of June 1.

The other two men arrested in the fight were Terris A. Simmons, 19, of 162 Bid Lane, Clinton, and Tysheem Bell, 20, of 1630 Lanefield Road, Warsaw,
Simmons was charged with resisting an officer; Bell was charged with resisting a public officer, being intoxicated and disruptive and second degree trespassing.
Simmons, was given a $500 bond, as well as a trail date of June 1; Bell was given a $3,000 bond and a trial date of June 1.
